§ 101001 Bakersfield Transit District Formation

This law lets the city of Bakersfield and nearby unincorporated Kern County set up a special public transit district because there’s no regular rule that lets them do it.

Key Takeaways

  • •A transit district can be formed for Bakersfield and nearby unincorporated Kern County.
  • •There is no existing general law that allows this, so a special law is required.
  • •The special law is meant to solve public transit problems in that area.

Example

Bakersfield wants more buses and better routes, but the usual state laws don’t allow a new transit district to be created there.

The city can pass a special law just for this area, creating a transit district that can plan and run the needed bus service.

§ 101001 Bakersfield Transit District Formation

It appears that public interest and necessity may require that a transit district be established in the territory comprising the City of Bakersfield and the unincorporated area of the County of Kern adjacent to the city in order to meet the public transit problems within such territory. There is no general law under which such a district could be formed and, accordingly, the enactment of a special law providing for the formation of such a special district is required.
