§ 884 Severability Of Provisions

This law says that if any part of this rule is found to be illegal or not work, the rest of the rule still stays in force.

Key Takeaways

  • •If one piece of a law is struck down, the other pieces keep working.
  • •The law is written so each part can stand on its own.
  • •Courts will try to keep as much of the law alive as possible.

Example

A city passes a rule that says no loud music after 10 PM and also says people must wear helmets while walking. A court says the helmet part is impossible, but the quiet‑time part is fine.

Because of this law, the quiet‑time rule stays valid even though the helmet rule is thrown out.
