§ 34 Devisee Definition And Trusts

This law explains who gets stuff when someone leaves things in their will. It says the person or trust named in the will gets the stuff, not the people who benefit from the trust.

Key Takeaways

  • •A 'devisee' is the person or thing named in a will to get something.
  • •If a will leaves something to a trust, the trust is the devisee, not the people who benefit from the trust.
  • •This is just about who gets the stuff first, not who uses it later.

Example

Grandma leaves her house to a trust for her grandchildren in her will.

The trust is the one getting the house, not the grandchildren directly. The trust is the 'devisee,' not the kids.
