Key Takeaways

  • •File the case in the superior court of the county where the dead person lived or where the property is.
  • •Start the case by filing a petition.
  • •The petition must include the jurisdiction facts and a clear description of the property and the filer’s interest.

Example

Emily's aunt lived in County X but owned a cabin in County Y. After the aunt dies, Emily wants to claim the cabin.

Emily can file her case in the superior court of County X (where her aunt lived) or County Y (where the cabin is). She must file a petition that lists the basic facts about the case and describes the cabin and her right to it.
