§ 1490 Guardian Means Conservator

This law says that the word "guardian" in other state laws actually means the person who has legal authority over an adult or a married minor, which is called a conservator.

Key Takeaways

  • •The term "guardian" is defined as a conservator.
  • •It applies to adults and married minors.
  • •The definition does not apply when Section 1510.1 says otherwise.

Example

A married 17‑year‑old gets into a car accident and needs surgery.

A law that requires a "guardian" to give permission for the surgery is really talking about the minor's conservator, not a parent or someone else.
