§ 1209 Notice To Attorney General

This law says that any required notice to the State of California must be sent to the Attorney General, and the Attorney General can still object to a settlement that harms a charitable gift even if they don’t show up at a mediation or other court‑ordered dispute‑resolution meeting.

Key Takeaways

  • •All required notices to the State go to the Attorney General.
  • •The notice must be delivered to the AG’s Sacramento office as described in Section 1215.
  • •The Attorney General can still object to a settlement that hurts a charitable gift, even if they don’t appear at mediation or other court‑ordered dispute‑resolution sessions.

Example

A charity is sued and the parties want to settle. The settlement would reduce the amount of money the charity receives.

The notice about the settlement has to be sent to the Attorney General’s office in Sacramento, and the Attorney General can still object to the deal even if they skip the mediation meeting.
