§ 6806 Reservation Of Joint Use Rights

This law says the commission can decide how easements or rights of way on leased land can be used, even letting several people share them, if that helps with mining the land.

Key Takeaways

  • •The commission keeps the power to set sharing rules for easements and rights of way.
  • •Sharing can be joint (together) or several (each on its own) as the commission decides.
  • •This applies to easements in tunnels and other ways needed for mining the land.

Example

A mining company rents a piece of land that has a tunnel going under it. The commission can require that the company share that tunnel with another mining company so both can get to their mineral deposits.

The commission sets the sharing rules, so both companies can use the tunnel even though they have separate leases.
