§ 405 Riot Participation Penalties

Every person who participates in any riot is punishable by a fine not exceeding one thousand dollars, or by imprisonment in a county jail not exceeding one year, or by both such fine and imprisonment. (Amended by Stats. 1957, Ch. 139.) 405a.    A person who participates in the taking by means of a riot of another person from the lawful custody of a peace officer is guilty of a felony, punishable by imprisonment pursuant to subdivision (h) of Section 1170 for two, three, or four years. (Amended by Stats. 2015, Ch. 47, Sec. 1. (SB 629) Effective January 1, 2016.)
