§ 264 Deserter Roll Removal Authority

This law lets the Governor remove a soldier who has deserted from the military's official records.

Key Takeaways

  • •A deserter can be removed from the organization's rolls.
  • •Removal only happens if the deserter is not under formal charges.
  • •The Governor must give express authority for the removal.

Example

A soldier leaves his unit without permission and is later found to have deserted, but he is not currently facing any legal charges.

Because he is a deserter and not under charges, the Governor can order that his name be taken off the unit's roster.
