§ 1190 District Corporate Powers

This law says each district is treated like a public corporation that can keep existing forever, sue or be sued, have its own seal, ask the district attorney for help, and make contracts or hire workers to do its jobs.

Key Takeaways

  • •Each district is a public corporation with permanent existence.
  • •The district can sue and be sued in any proper court.
  • •It can have its own official seal and change it whenever it wants.
  • •The district can ask the district attorney for legal advice and help.
  • •It can sign contracts, hire workers, and do anything needed to use its powers.

Example

A district wants to build a new community center and hires a construction company to do the work.

Because the district is a public corporation, it can sign a contract with the builder, hire the workers, and if the builder messes up, the district can sue them in court. The district can also be sued by the builder if the district doesn’t pay.
