§ 8391 Casket-Free Human Remains Reduction

Key Takeaways

  • •You don’t have to put a dead body in a fancy casket before cremation or other reduction processes.
  • •A place that does cremation can’t refuse a body just because it’s not in a casket.
  • •They can still ask for some kind of simple container, just not a casket.
  • •If they break this rule, they can get in trouble with the law.

Example

A family wants to cremate their loved one but doesn’t want to buy an expensive casket. They bring the body in a simple wooden box.

The cremation place can’t say no just because there’s no casket. They can ask for a basic container, but they can’t force the family to buy a casket.
