§ 79940 Lien Priority And Recording

Key Takeaways

  • •This law creates a special claim on someone's property if they owe money.
  • •The claim works like a court order and must be officially recorded in the county where the property is.
  • •Once recorded, this claim gets priority, meaning it might get paid before other debts.

Example

If a contractor fixes your house but you don’t pay them, they can put a claim on your house.

The contractor records this claim with the county, and it acts like a court order. If you sell your house, the contractor might get paid from the sale before other people you owe money to.
