§ 79875 Affiliate And Consultant Definitions

Key Takeaways

  • •This law defines who is connected to the owner of a specific old steel mill site in Fontana.
  • •An 'affiliate' is someone or a company that controls or is controlled by the owner, or owns more than half of the company.
  • •A 'qualified independent consultant' is a licensed geologist or engineer who can give expert advice on the site.
  • •The 'responsible party owner' is the person or company that owned the site on January 1, 1993, or just before it was transferred to a joint venture for development.

Example

Imagine a big old factory in Fontana that used to make steel. The factory is now closed, and the land needs to be cleaned up.

The law says that the person who owned the factory on January 1, 1993, is responsible for the site. If that person sold the land to a group of companies working together to build something new, then the person who owned it just before the sale is still responsible. Also, if a big company owns more than half of the factory's ownership, that big company is connected to the owner and might also be involved.
