§ 4740 District Property Acquisition Authority

Key Takeaways

  • •The district can buy, own, or get rid of land or stuff needed for sewer or trash systems.
  • •They can get property by buying it, receiving it as a gift, or even taking it if really needed (but they have to follow rules).
  • •Trash includes food scraps, yard waste, garbage, and anything else thrown away as useless.

Example

The district wants to build a new trash dump but needs a piece of land that someone owns.

The district can try to buy the land from the owner. If the owner won’t sell, the district might be able to take it (with fair payment) to build the dump because it’s for public use.
