§ 42452 Abatement Order Conditions

Key Takeaways

  • •The law can tell someone to stop doing something bad, like a court order.
  • •Sometimes, the order can have conditions—like 'stop doing this unless you do that first.'
  • •The order can’t let someone break the rules forever—it has to follow all the rules for exceptions, like time limits.

Example

A factory is dumping dirty water into a river, making it unsafe for fish and people.

The law can order the factory to stop dumping dirty water. But maybe the order says, 'You can keep dumping a little bit if you clean it up by next year.' If the factory doesn’t clean it up in time, they have to stop completely.

The order for abatement shall be framed in the manner of a writ of injunction requiring the respondent to refrain from a particular act. The order may be conditional and require a respondent to refrain from a particular act unless certain conditions are met. The order shall not have the effect of permitting a variance unless all the conditions for a variance, including limitation of time, are met. (Added by Stats. 1975, Ch. 957.)
