§ 42363 Variance Revocation Hearing Process

• •Before taking away or changing a special permission (variance), the state must hold a meeting (hearing).
• •The person who got the special permission must be told right away about the meeting.
• •That person can go to the meeting, bring people to talk, and ask questions, just like they’re part of the meeting.

A factory got special permission to release a little more smoke than usual. Now, the state wants to take that permission away.

The state must first hold a meeting and tell the factory right away. The factory can go to the meeting, bring workers or experts to talk, and ask questions to explain why they should keep the permission.
