§ 42335 Permit Denial Appeal Conditions

Key Takeaways

  • •If your permit is denied because of pollution problems, you can ask a board to change their decision.
  • •You can win your case if you prove the pollution wasn’t your fault or you tried hard to stop it.
  • •You can also win if the punishment is too harsh for the mistake or if you fixed the problem quickly.

Example

A factory gets denied a permit because their machines leaked smoke.

If the factory shows the leak happened because of a sudden storm they couldn’t stop, the board might give them the permit. Or if they fixed the machines right away, they could get another chance.
