§ 33394 Property Acquisition Consent Rules

Key Takeaways

  • •The government can't take your land if there's a building on it that they plan to keep as-is, unless they need to fix or change the building or the land.
  • •If the government wants to change your building or land to fit their plans, they must ask you first.
  • •If you don't agree to their plans, they might still take your land, but only if they really need to change it.

Example

Imagine you own a small shop in a neighborhood the city wants to update. Your shop is old but still works fine.

The city can't just take your shop if they want to keep it exactly how it is. But if they think your shop needs big repairs or if they want to change how the land is used, they have to talk to you first. If you say no, they might still take it, but only if they really need to make those changes.
