§ 25542 Facility Safety Penalty Coordination

Key Takeaways

  • •If a workplace has safety rules from both state and federal laws, they can only be punished once for breaking the same rule.
  • •The state safety office should work with other agencies to avoid confusing or double-punishing workplaces.
  • •This is about making safety rules clearer and fairer for workplaces.

Example

A factory has a safety rule to check machines every month. The same rule is in both state and federal laws.

If the factory skips a check, they can only get one fine, not two—one from the state and one from the federal government.
