§ 17925 Local Building Standard Appeals

Key Takeaways

  • •If you don't like a building rule in your area, you can ask for a meeting to talk about it.
  • •A local group will listen and decide if the rule is too hard to follow in your area because of special local reasons.
  • •If they agree the rule is unfair for your area, you don’t have to follow it there.
  • •The local group must tell the state why they made this decision.

Example

A small town wants to build houses with wooden porches, but a state rule says all porches must be made of metal to prevent fires.

The town can ask for a meeting and say, 'Our town is always wet and never has fires, so wooden porches are safe here.' If the local group agrees, the town can keep using wood for porches, but they have to tell the state why.

§ 17925 Local Building Standard Appeals

Except as provided in Section 17922.6, any person, firm, corporation, or governmental agency that opposes the application of any applicable building standard published in the State Building Standards Code or any other rule or regulation adopted by the department within a particular local area may request a hearing before the local appeals board regarding the matter. If the local appeals board determines after the hearing that because of local conditions or factors it is not reasonable for the building standard, rule, or regulation to be applied in the local area, the building standard, rule, or regulation shall have no application within that local area. A copy of the determination of the local appeals board, together with a report of the local conditions upon which the determination is based, shall be filed with the department pursuant to Section 17958.7. (Amended by Stats. 1983, Ch. 101, Sec. 130.)
