§ 1306 Insured Settlement Consent

Key Takeaways

  • •Insurance companies can't settle a claim for more than $3,000 without your written permission.
  • •Both you and the insurance company must agree to skip the written permission rule.
  • •This rule only applies to insurance policies made or renewed after January 1, 1971.

Example

You get into a car crash, and the other driver's insurance wants to pay you $4,000 to fix your car.

The insurance company can't pay you the $4,000 unless you sign a paper saying it's okay. If they pay you without your permission, the payment isn't automatically canceled, but they still shouldn't have done it.
