§ 128766 Health Data Disclosure

Key Takeaways

  • •Hospitals and health departments in California can ask for and share certain health information to help with important health work.
  • •This information can also be shared with big health groups like the Centers for Disease Control (CDC) to study diseases or improve health care.
  • •Hospitals getting this info can't share it with others unless a court or the law says they must.
  • •If sharing the info could hurt someone's privacy too much, the health department won't share it and will explain why.

Example

A hospital in Los Angeles wants to share info about flu cases with the CDC to help track how the flu is spreading.

The hospital can share this info with the CDC because it helps them study and fight the flu. But the hospital can't share this info with anyone else, like a news reporter, unless a court orders it.
