§ 1241 License Suspension Proceedings

• •If the state wants to take away, suspend, or refuse to give a special license or permit, they have to follow the rules in Chapter 5 of the Government Code.
• •The Government Code rules are the boss—if this law and the Government Code disagree, the Government Code wins.
• •The state department in charge gets all the powers listed in those Government Code rules.

A restaurant owner applies for a special permit to sell alcohol, but the state wants to deny it because of past violations.

The state must follow the exact steps and rules in Chapter 5 of the Government Code to decide whether to deny the permit. If this law says one thing and the Government Code says another, they have to do what the Government Code says.
