§ 1237 Clinic Ownership Transfer Actions

Key Takeaways

  • •If the boss sues a clinic, the lawsuit doesn’t stop just because the clinic gets a new owner.
  • •The lawsuit keeps going unless the boss says in writing it’s okay to stop it.
  • •The new owner can’t just say 'not my problem'—they have to deal with the lawsuit too.

Example

A clinic gets sued because it didn’t follow health rules. While the lawsuit is happening, the clinic is sold to a new owner.

The lawsuit doesn’t go away just because the clinic has a new owner. The new owner has to fix the problems or keep fighting the lawsuit unless the boss who sued says in writing it’s okay to stop.
