§ 1205 Clinic Licensing Requirements

Key Takeaways

  • •You can't run a clinic without a license from the state.
  • •If you want to offer special services at your clinic, you need an extra permit.
  • •If you already have a clinic and start offering a new service that later needs a permit, you can keep doing it until the state checks it and tells you if you can keep going or must stop.

Example

A small health clinic wants to start giving flu shots.

The clinic must first get a special permit from the state to give flu shots. If they start giving flu shots without the permit, they could get in trouble. But if they were already giving flu shots before the rule changed, they can keep doing it until the state says yes or no to their permit.

However, any licensed clinic offering any service which is later designated by regulation of the state department as a special service shall be allowed to continue offering such service until the state department evaluates the quality of such service and issues a special permit therefor or notifies the licensee that it is not eligible for a special permit and must cease and desist from offering such service.
