§ 12007 Local Issuing Authority Designation

Key Takeaways

  • •The 'issuing authority' is the person or office in charge of giving out permits or approvals for certain things, like fire safety or police matters.
  • •This person can be the county sheriff, the head of the city police, or the chief of a full-time fire department.
  • •The local government (like a city or county) must pick one of these people to be the issuing authority and tell the State Fire Marshal who they chose.
  • •If the local government doesn’t pick someone, the State Fire Marshal will automatically choose the county sheriff to be the issuing authority.

Example

Imagine your town needs someone to approve fire safety permits for new buildings.

The town council must decide who is in charge—like the fire chief, police chief, or sheriff. If they don’t decide, the State Fire Marshal will say the sheriff is in charge.
