§ 11583 Property Removal And Sale Fees

Key Takeaways

  • •If someone has to take and sell your stuff (like furniture or a TV) because you owe money, the person doing this can charge you a fee for their work.
  • •The fee is the same as if they were taking and selling your stuff because of a court order.
  • •If they have to lock up a place (like a house or a store) and keep it locked, they can ask the court for extra money for that job.
  • •The court decides what’s a fair amount for locking up the place.

Example

You owe someone a lot of money, and they get permission to take your stuff to sell it and pay off the debt.

The person taking your stuff can charge you a fee for doing that, just like if the court ordered it. If they have to lock up your house to keep everything safe while they sell your things, they can ask the court to pay them extra for that.
