§ 11551 Probation Drug Testing Requirement

Key Takeaways

  • •If a court gives someone probation and thinks they use drugs, they can make the person take drug tests.
  • •The test results go to the probation officer to check if the person is still using drugs.
  • •If someone is on parole and used drugs before, they might also have to take drug tests.
  • •The county or state pays for these drug tests, depending on who is in charge of the parole.

Example

If someone gets caught with drugs and the court lets them stay out of jail on probation, the judge can say they have to take drug tests to make sure they’re not using drugs anymore.

The person on probation has to take the tests, and if they fail, the probation officer will know and might send them to jail.
