§ 11476 Controlled Plant Seizure Rules

Key Takeaways

  • •If you grow plants that can make illegal drugs (like some kinds of poppies or cannabis), the police can take them away.
  • •Even if the plants are growing wild or you don’t know who owns them, the state can still take them.
  • •This rule is about plants that can make very strong or dangerous drugs, not regular plants.

Example

Someone grows a bunch of poppy plants in their backyard to make opium, which is illegal.

The police can come and take those plants away, even if no one is there to claim them. The plants are now the state’s property.
