§ 111850 Burden Of Proof Exemptions

Key Takeaways

  • •If the state says you broke a rule, they don’t have to prove you didn’t qualify for any exceptions.
  • •It’s your job to prove you fit an exception if you say you didn’t break the rule.
  • •The state only has to show you did something wrong, not that you don’t get a special pass.

Example

You get a ticket for selling food without a permit, but you think you don’t need one because you’re selling at a small farmers' market.

The state doesn’t have to prove you weren’t allowed to sell without a permit. You have to show the rules say you’re allowed to do it without one.
