§ 109350 Unapproved Drug Cease Orders

This law says the health department can stop people from using or selling medicines or devices that haven't been officially approved, unless they're exempt.

Key Takeaways

  • •You can't sell or recommend unapproved medicines or medical devices.
  • •The health department can order you to stop if you do.
  • •Some things are exempt, but most need approval.

Example

A company starts selling a new vitamin drink that claims to cure the flu, but it was never checked or approved by the health department.

The health department can tell the company to stop selling the drink because it wasn't approved and isn't exempt.
