§ 108260 Hazardous Substance Label Protection

It is illegal to change, damage, or remove labels on dangerous chemicals in a way that makes them misbranded or banned.

Key Takeaways

  • •You cannot alter or remove labels on hazardous chemicals.
  • •Doing so is illegal if it makes the product misbranded or banned.
  • •The rule protects people from accidental misuse of dangerous items.

Example

A worker takes off the warning label from a container of strong cleaning spray so coworkers don't see the danger and use it without protection.

Removing the label makes the spray a misbranded hazardous substance, which breaks this law.
