§ 108175 Definition Of Strong Sensitizer

This law defines what a 'strong sensitizer' is and requires the department to officially label a substance as such only if it can cause allergic or photodynamic reactions that reappear when the substance is used again, after checking how often and how severe those reactions are.

Key Takeaways

  • •A 'strong sensitizer' causes an allergic or light‑triggered reaction that shows up again when the substance is used later.
  • •The department must decide if a substance is a strong sensitizer by looking at how often reactions happen and how serious they are.
  • •Only after this review can the department officially designate a substance as a strong sensitizer.

Example

A worker repeatedly uses a skin cleaner that contains a chemical the department has labeled as a strong sensitizer, and develops an itchy rash each time they use it.

Because the chemical has been designated a strong sensitizer, the law says the worker’s allergic reaction is expected and the employer must take steps to protect them, such as providing safer alternatives or protective gear.

§ 108175 Definition Of Strong Sensitizer

“Strong sensitizer” means a substance that will cause on normal living tissue through an allergic or photodynamic process a hypersensitivity that becomes evident on reapplication of the same substance and that is designated by the department. Before designating any substance as a strong sensitizer, the department, upon consideration of the frequency of occurrence and severity of the reaction, shall find that the substance has a significant potential for causing hypersensitivity.
