§ 103447 Birth Certificate Gender Correction

This law lets anyone born in the state (or their parent/guardian if they’re a minor) get a new birth certificate and have the old one sealed if the original listed the wrong gender.

Key Takeaways

  • •Anyone born in the state (or their parent/guardian for minors) can request a corrected birth certificate if the gender was recorded wrong.
  • •The old certificate will be sealed once a new one is issued.
  • •The request must include a sworn affidavit showing the error came from the hospital, the local registrar, or a doctor and parent who were present at birth.

Example

Alex was born in the state and the hospital mistakenly wrote "male" on the birth certificate, but Alex is female.

Alex can ask the State Registrar for a new birth certificate that shows the correct gender and have the wrong one sealed, but Alex must include a sworn statement from the hospital or a doctor proving the mistake.

(b)  The application shall be accompanied by one of the following: (1)  The sworn affidavit of the administrator of the hospital where the applicant was born or by a representative designated by the administrator, verifying that the incorrect gender information entered on the birth certificate was due to a hospital error. (2)  The sworn affidavit of the representative of the local registrar, verifying that the incorrect gender information entered on the birth certificate was due to an administrative error of the local registrar. (3)  The sworn affidavit of the physician attending the birth of the applicant and the sworn affidavit of the applicant’s mother or father or a relative who was at least five years old at the time of the applicant’s birth, verifying that, at the time of birth, the applicant’s gender was different from that indicated on the original birth certificate.
