§ 100832 Regulation Continuation Post-2006

This law says that any rules the department had right before Jan 1 2006 keep working until the department officially changes or cancels them using the proper rulemaking steps.

Key Takeaways

  • •Old department rules stay in effect after Jan 1 2006.
  • •They only stop when the department formally repeals or amends them.
  • •Any changes must follow the rulemaking steps in the Administrative Procedure Act.

Example

A business has been following a department rule about how to apply for a license that was written in 2004.

Because the rule was in place before Jan 1 2006, it still applies today unless the department goes through the official process to update or remove it.
