§ 100450 Annual License Fee Adjustment

This law says the state changes the fees you pay to get or renew a professional license every year so the money collected matches the cost of running the licensing program, and the department must publish the new fee amounts by January 1.

Key Takeaways

  • •License fees are adjusted every calendar year.
  • •The adjustment is set so the fees cover the estimated cost of the licensing program.
  • •The department must publish the exact fee numbers by January 1 each year.
  • •The publishing of the fee list is not subject to certain other government‑code rules.

Example

Maria wants to renew her cosmetology license in March. She looks at the fee list the department posted on January 1 and pays the amount shown there.

Because the law requires the department to update and publish the exact fee each year, Maria’s renewal fee is the current, adjusted amount that covers the program’s costs.

§ 100450 Annual License Fee Adjustment

(a)  The fees or charges required to accompany an application for the issuance or renewal of any license pursuant to Section 1300 of the Business and Professions Code or pursuant to Sections 1616 or 1639.5 shall be adjusted annually pursuant to Section 1300.2 of the Business and Professions Code. The fees or charges subject to adjustment pursuant to this subdivision shall be the fees or charges that would have been payable in the prior calendar year without regard to the provisions of subdivision (b). (b) The annual adjustment for fees or charges assessed under subdivision (a) shall be determined by the department so that license fee revenues cover the estimated licensing program costs pursuant to Section 1300.2 of the Business and Professions Code. (c) The department shall by January 1 of each year publish a list of actual numerical fee charges as adjusted pursuant to this section. This adjustment of fees and the publication of the fee list shall not be subject to the requirements of Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code.
