§ 100160 Employee Transfer Protection

This law moves all regular (non‑temporary) State Health Department workers who were doing health‑related jobs on July 1 1978 into the Department of Health, and they keep the same job status, pay, and benefits.

Key Takeaways

  • •Only employees who were on the job on July 1 1978 are covered.
  • •The rule applies only to regular civil‑service staff, not temporary workers.
  • •Those transferred keep their current job title, pay, and benefits, unless their job is exempt from civil service.

Example

A health inspector who was hired by a city agency before July 1 1978 and was a civil‑service employee gets transferred to the State Department of Health.

Because the inspector was a regular civil‑service employee on that date, the law says they are moved to the state department but keep their same position, salary, and rights.
