§ 6023 Harbor Improvement Feasibility Review

The board of supervisors checks a petition to see if a harbor project is doable and good for the area, and they must finish the hearing within six months of the petition.

Key Takeaways

  • •The board must decide if a harbor improvement is feasible and beneficial.
  • •Hearings can go longer than 90 days only if the board says more investigation is needed.
  • •All hearings must be wrapped up within six months after the petition is filed.

Example

A company asks to build a new dock in the harbor and submits a petition.

The board looks at the plan to decide if it can be done and if it will help the harbor and nearby property. If they need more time, they can keep the hearing going past 90 days, but they must finish everything within six months of the petition date.

The board of supervisors shall investigate and determine whether or not the improvement and development work generally described in the petition is feasible and whether, when completed, it will result in the improvement and development of the harbor and become a benefit to the property within the district. If it appears, and the board of supervisors finds, that it is necessary in order to make sufficient and adequate investigation upon which to determine such questions to continue the hearing beyond ninety days, the board of supervisors may do so, but the hearing shall be completed within six months from the date of the presentation of the petition.
