§ 4153 Towpath Fence Regulations

This law says you don’t have to put up fences on either side of a towpath, but the local board can set rules, put up gates, and protect the land the towpath goes through.

Key Takeaways

  • •No fence is required on either side of a towpath.
  • •The board of supervisors can create rules for how towpaths are run.
  • •The board can install gates and take steps to protect the property the towpath crosses.

Example

A walking path runs alongside a river and crosses a farmer’s field. The board decides to put a gate at the field’s edge so people can’t drive tractors onto the path and damage the farmer’s crops.

Even though the law doesn’t force a fence, the board can add a gate and make rules to keep the farmer’s land safe while still letting people use the towpath.
