§ 305 Felony Acts Under Section 304

This law says that if you are not the kind of person described in Section 304 and you do any of the actions listed in Section 304, you are committing a felony.

Key Takeaways

  • •Only the actions named in Section 304 are covered.
  • •If you are not the specific person described in Section 304, doing those actions is a felony.
  • •A felony is a serious crime with big penalties.

Example

Someone who is not a government employee (the type mentioned in Section 304) illegally dumps trash, which is one of the actions listed in Section 304.

Because they are not the person described in Section 304, doing that illegal dumping makes them guilty of a felony under this law.
