§ 1180 Pilot License Emergency Suspension

The board can put a pilot’s license on hold for up to 40 days without a hearing if they think it’s needed for safety or health reasons, but they must tell the pilot why within six days or the hold ends early.

Key Takeaways

  • •The board may suspend a pilot’s license without a hearing for up to 40 days.
  • •Suspension can happen if the pilot is accused of misconduct listed in Section 1181 or if they may not meet health/physical standards.
  • •The board must serve a formal accusation within six days, or the suspension ends at the end of the sixth day.

Example

A pilot is suspected of being too sick to fly safely.

The board can suspend the pilot’s license for, say, 30 days while they investigate. If the board does not send the pilot a formal notice of the accusation by the end of the sixth day, the suspension automatically ends after those six days.

§ 1180 Pilot License Emergency Suspension

If, in the opinion of the board, there is reasonable cause to believe that the public interest requires that a pilot be summarily suspended pending hearing on charges of misconduct that include any of the causes for suspension or revocation specified in Section 1181 or if the board has information that leads it to believe that a pilot has become unable to comply with the standards of health or physical condition requisite to a pilot’s duties, the board may, without hearing, temporarily suspend the license of the pilot for not exceeding 40 days pending hearing and decision on the charges. Unless an accusation on the charge is served on the pilot as provided in Chapter 5 (commencing with Section 11500) of Part 1 of Division 3 of Title 2 of the Government Code, prior to the close of the sixth day after the suspension becomes effective, the temporary suspension terminates at the close of the sixth day. (Amended by Stats. 2011, Ch. 324, Sec. 18. (AB 1025) Effective January 1, 2012.)
