§ 88006 Ballot Pamphlet Content Challenges

Key Takeaways

  • •The Secretary of State must show the ballot pamphlet text to the public at least 20 days before printing it.
  • •If someone thinks the text is wrong or misleading, they can ask a court to fix or remove it.
  • •The court will only make changes if it’s very clear the text is bad and it won’t mess up printing the pamphlets on time.
  • •Any legal fight about this must happen in Sacramento County.

Example

A voter sees a description in the ballot pamphlet that says a new tax will only affect rich people, but they know it will actually affect everyone.

The voter can go to court in Sacramento and ask to have the description fixed or removed if they can prove it’s misleading. The court will check if changing it won’t delay printing the pamphlets.

Venue for a proceeding under this section shall be exclusively in Sacramento County. The Secretary of State shall be named as the respondent and the State Printer and the person or official who authored the copy in question shall be named as real parties in interest.
