§ 75055 Nonmember Retirement Eligibility

Key Takeaways

  • •You can retire early if you're not a member but meet certain rules.
  • •You must be at least 50 years old.
  • •Your spouse (the member) must have worked at least 5 years before you split up.
  • •Your spouse must also be able to retire and get their pension when you apply.

Example

A couple divorces when the husband (the member) has worked 10 years in a job with a pension. Later, the wife (nonmember) turns 50 and wants to retire.

If the husband is already old enough to get his pension, the wife can apply to retire early too, even if she wasn’t part of the pension plan.
