Key Takeaways

  • •If a judge leaves their job to serve in the military during a war or national emergency, that time still counts toward their retirement years.
  • •Judges get an extra 6 months added to their retirement time after they finish military service.
  • •This rule also applies to judges who served in the military before this law was made, including those who served between September 16, 1940, and December 7, 1941.
  • •If a judge quit their job to join the military during a national emergency and came back within 90 days after leaving the military, their military time counts too.

Example

§ 75031 Military Service Credit For Judges

In computing the number of years a person has been a judge for the purposes of retirement under Sections 75025 or 75060, there shall be included any time as he or she was absent from his or her position as judge by reason of service with the armed forces of the United States during a war involving the United States as a belligerent or in any other national emergency, and for six months thereafter. This section shall be retroactively applied to extend its benefits to all judges who served in the military service in time of war, including the period September 16, 1940, to December 7, 1941, and who return or have returned to their positions upon the termination of their military service or within six months thereafter. The provisions of this section apply to any person who resigned judicial office to enter military service in time of national emergency declared by the President prior to the authorization by law of military leave, if he or she returned to judicial office within 90 days after his or her separation from military service. (Amended by Stats. 2002, Ch. 664, Sec. 127.3. Effective January 1, 2003.)
