§ 6515 Joint Powers Revenue Bonds

Key Takeaways

  • •Special groups (like a city and an irrigation district working together) can borrow money by selling bonds to build or fix water projects.
  • •Before borrowing money, both the city and the irrigation district must ask their voters. If most voters say yes, they can go ahead.
  • •This rule was only supposed to work until the end of 1973, unless there was a lawsuit. Then it could last a little longer.

Example

A city and a nearby farm area want to build a big water pipe together so everyone has enough water.

They can ask the people who live there to vote. If most people vote yes, they can borrow money by selling bonds to pay for the pipe. But they had to do this before 1974, unless they got stuck in court.

§ 6515 Joint Powers Revenue Bonds

In addition to other powers, any agency, commission or board provided for by a joint powers agreement entered into pursuant to Article 1 (commencing with Section 6500) of this chapter between an irrigation district and a city, if such entity has the power to acquire, construct, maintain or operate systems, plants, buildings, works and other facilities and property for the supplying of water for domestic, irrigation, sanitation, industrial, fire protection, recreation or any other public or private uses, may issue revenue bonds pursuant to the Revenue Bond Law of 1941 (commencing with Section 54300) to pay the cost and expenses of acquiring, constructing, improving and financing a project for any or all of such purposes. Upon the entity adopting the resolution referred to in Article 3 (commencing with Section 54380) the irrigation district and the city shall implement the same by each conducting the election in its own territory. The proposition authorizing the bonds shall be deemed adopted if it receives the affirmative vote of a majority of all the voters voting on the proposition within the entity. The provisions of this section shall be of no further force and effect after December 31, 1973, unless the entity is unable to accomplish the purpose of this section by reason of litigation, in which case this section shall continue to be effective until the final determination of such litigation and for one year thereafter. (Added by Stats. 1971, Ch. 1603. Inoperative on January 1, 1974, or later date prescribed by its own provisions.)
