§ 62572 Commercial Linkage Fee Limits

Key Takeaways

  • •Businesses building new stuff (like stores or offices) might have to pay a fee to help build homes for people who will work there.
  • •The fee can't be too high—it has to match the real cost of building those homes, based on a study.
  • •The fee can also cover the cost of managing the program, but nothing extra.
  • •This rule is just writing down what was already decided in court—it’s not a new law.

Example

A big company wants to build a new office building in a city.

The city can make the company pay a fee to help build homes for the new workers. But the fee can’t be more than what it actually costs to build those homes, based on a study. If the city tries to charge way more, the company can say no.

(b) It is the intent of the Legislature in adding this section to codify existing constitutional and decisional law with respect to the imposition of development fees and monetary exactions on developments by local agencies. This section is declaratory of existing law and shall not be construed or interpreted as creating new law or as modifying or changing existing law. (Added by Stats. 2024, Ch. 767, Sec. 1.
