§ 61012 District Formation Notice Requirements

Key Takeaways

  • •Before asking people to sign a petition to create a new district, the people in charge must tell everyone their plans by publishing a notice in a local newspaper.
  • •The notice must explain why they want to create the district, what services it will provide, and how it will be paid for.
  • •If the district covers more than one county, the notice must be published in a newspaper in each of those counties.
  • •After the notice is published, the people in charge have to prove they published it by filing a copy and a statement from the newspaper with the local government office.

Example

A group of people want to create a new school district in two counties.

Before they can start asking people to sign their petition, they must publish a notice in a newspaper in each county. The notice must explain why they want the new school district, what schools or services it will provide, and how it will be paid for. After the notice is published, they have to file a copy of it and a statement from the newspaper proving it was published with the local government office. Only then can they start collecting signatures for their petition.
