§ 57329 Annexed Roads Become City Streets

Key Takeaways

  • •When a piece of land becomes part of a city, the roads in that area become city streets instead of county roads.
  • •This doesn't happen if the road was added to the county system after people started asking for the land to become part of the city.
  • •The city doesn't have to fix up or improve these roads to match city standards.

Example

A small town area with a few roads gets added to a nearby city.

The roads in that area will now be taken care of by the city, not the county. But if the county added a new road to their system after people started asking for the area to join the city, that road stays with the county. Also, the city doesn't have to make these roads nicer or bigger right away.

(a) If unincorporated territory was, or is hereafter, annexed to a city, all roads and highways or portions of a road or highway in the territory which had been accepted into the county road system pursuant to Section 941 of the Streets and Highways Code are, or shall become, as the case may be, city streets on the effective date of the annexation. (b) Subdivision (a) does not apply to a road or highway which had been accepted into the county road system pursuant to Section 941 of the Streets and Highways Code after the date of the first signature on a petition for annexation or incorporation, the adoption of a resolution of application by an affected local agency, or a date mutually agreed upon by the city and the county. (c) Nothing in subdivision (a) requires a city to improve the affected road or highway to city standards. (Added by Stats. 1991, Ch. 531, Sec. 1.)
