§ 53982 Challenging Local Financing Actions

Key Takeaways

  • •If someone is unsure if a city or county decision (like a new rule or way to pay for something) is legal, they can ask a court to check it.
  • •This only applies to decisions made under certain parts of the law (like Section 53990 or this section).
  • •The court will use a special process (Chapter 9 of the Code of Civil Procedure) to decide if the decision is valid.

Example

A city decides to build a new park and says they will pay for it by charging a fee to all homeowners. Some people think this fee is not fair or legal.

Those people can go to court and ask a judge to check if the city’s decision to charge the fee is allowed by the law. The judge will look at the rules in Chapter 9 of the Code of Civil Procedure to make the decision.
