§ 53077 District Term Limits

Key Takeaways

  • •Local areas can decide if they want to limit how long someone can be in charge.
  • •If they want to make a rule about term limits, everyone in the area gets to vote on it.
  • •The rule only applies to future leaders, not the ones already in charge.
  • •This is for special local government areas, not the whole state.

Example

A small town wants to make a rule that says no one can be mayor for more than 8 years.

The town can vote on this rule, but it won’t kick out the current mayor. It only applies to mayors elected after the rule passes.

Any proposal to limit the number of terms a member of the governing body of the district may serve on the governing body of the district shall apply prospectively and shall not become operative unless it is submitted to the electors of the district at a regularly scheduled election and a majority of the votes cast on the question favor the adoption of the proposal. (b) For purposes of this section, the term “district” shall mean an agency of the state, formed pursuant to general law or special act, for the performance of governmental or proprietary functions within limited boundaries.
